1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding legal contract between you and Swapo Inc. (“Swapo,” “we,” “us,” or “our”). By accessing, browsing, or using the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any provision of these Terms, you must immediately cease all use of the Services.

1. Account Responsibilities

To access certain features of the Services, you must register for an account and provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your password and for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach. We reserve the right to suspend or terminate your account if any information provided by you is found to be inaccurate, misleading, or in violation of these Terms.

1. Tokens & Payments

Swapo operates on a token-based system. All transactions for booking sessions or purchasing in-platform services require Swapo tokens (“TK”). Tokens may be purchased via our approved payment methods, including credit/debit cards and authorized third-party payment processors. All token purchases are final and non-refundable unless otherwise specified in these Terms or required by applicable law. Swapo does not guarantee any specific outcome or benefit from token purchases.

1. Cancellations & Refunds

To cancel a booked session and receive a refund of tokens, you must do so at least twenty-four (24) hours before the scheduled start time. If you cancel less than 24 hours in advance, you will forfeit the tokens unless the tutor consents to a refund. In the event of a tutor-initiated cancellation, you will receive a full token refund automatically. All refund requests must be submitted through the platform’s cancellation interface. Refunds will be issued in tokens and reflected in your account within 48 hours.

1. User Conduct & Prohibited Activities

You agree to use Swapo in a lawful, ethical, and respectful manner. Prohibited conduct includes, but is not limited to: harassment, discrimination, hate speech, uploading harmful or infringing content, impersonation, and any activity that violates applicable laws or third-party rights. We reserve the right to suspend or terminate your access and to report illegal activities to law enforcement authorities. You remain solely responsible for your own conduct and content you post.

1. Disclaimers & Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SKILLSWAP DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLSWAP’S TOTAL LIABILITY FOR ANY AND ALL CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL NUMBER OF TOKENS YOU HAVE SPENT ON THE PLATFORM DURING THE SIX (6) MONTHS PRIOR TO THE CLAIM.

1. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree that exclusive jurisdiction and venue for any dispute shall reside in the courts of Bengaluru, India, and you hereby consent to personal jurisdiction in such courts.
